About these terms
These terms are an agreement between you and William March, trading as Resurface ("Resurface", "we", "us"). Resurface is a trading name of William March, a sole trader based in the UK. Business address: 4a Victoria Grove, Bridport, DT6 5AW. Email: hello@tryresurface.co.uk.
They apply when you subscribe to Resurface or use tryresurface.co.uk. Please read them together with our Privacy policy and Cookie policy.
Resurface is sold to businesses. By subscribing you confirm that you are acting for your trade, business or profession, for example as a roofer or driveway installer. Consumer protection rules that only apply to consumers, such as the 14-day right to cancel online purchases, therefore do not apply to a subscription.
The service
Resurface is a roof and driveway visualiser for your website. Your customers upload a photo of their house, choose a roof or driveway product from our catalogue, and see a preview of their house with that product. Your subscription includes:
- the visualiser, added to your website with one line of code, with your business name, colour and quote button;
- a hosted page at tryresurface.co.uk/your-business-name, if you don't have a website or want a link to share;
- a monthly allowance of customer previews (see below).
Previews are AI visual previews, not a survey. They help your customers choose. They are not an exact colour match, measurement or quotation, and the result can be wrong, for example if the roof or driveway is hard to see in the photo. Product colours approximate the manufacturer's and will vary with light, batch and installation. You remain responsible for your quotes and for the work you do.
Product names. The catalogue uses the names of real products (for example Marshalls, Marley, Redland, Addagrip) so your customers recognise them. These names are trade marks of their owners. Resurface is not affiliated with or endorsed by them, and you must not present the visualiser as a manufacturer's own tool.
We may change, improve or remove features or catalogue products. If a change significantly reduces what you get, we will tell you before it happens, and you can cancel.
Price and payment
- The price is £90 a month, unless a different price is shown when you check out. The price shown at checkout is the one that applies to you.
- No VAT is charged, because Resurface is not VAT-registered.
- Stripe takes payment on its secure checkout page. We do not see or store your full card details. When you subscribe, you authorise us, through Stripe, to charge your payment method every month until you cancel.
- The subscription renews automatically each month.
- We may change the price. We will email you at least 30 days before a new price applies to your subscription, and you can cancel before it takes effect.
- If a payment fails, Stripe may try again. If we cannot collect payment, we may pause your visualiser until the payment is made.
Monthly previews
- Your subscription includes 300 customer previews a month, unless we agree a different allowance with you. A preview is one rendered photo. Our pre-rendered sample houses do not count.
- When the allowance is used up, your visualiser pauses and shows your visitors a polite message until it resets on the 1st of each month. If you need more, tell us and we will discuss raising it.
Setting it up
- After payment we email you your embed code. You add it to your website, or use your hosted page.
- You are responsible for your own website, for the link behind your quote button, and for telling your website's visitors that you use Resurface to provide the visualiser (for example in your own privacy notice). We can suggest wording.
- Keep your embed code to your own websites. If you think it is being used elsewhere, tell us and we will issue a new one.
Cancelling
- You can cancel at any time, with no minimum term. Cancel from your Stripe account link (the "Manage or cancel your subscription" link we give you), or email hello@tryresurface.co.uk and we will cancel for you.
- When you cancel: [CANCELLATION EFFECT: end of paid period or immediately].
- We do not refund part-months, unless the law requires it or we have broken these terms.
Acceptable use
You must not use Resurface, or let anyone use your visualiser:
- in a way that breaks any law or regulation, or infringes anyone's rights;
- to upload photos the uploader has no right to use, or photos meant to identify, track or harass people;
- to create misleading images, for example presenting a preview as a photo of finished work;
- to try to get around the preview allowance, usage limits or security measures, to scrape the service, or to send automated requests other than through the visualiser;
- to upload malware, or to interfere with or overload the service.
We may suspend a visualiser or close an account that breaks this section. Where it is reasonable to do so, we will tell you first and give you a chance to fix the problem.
Data protection
When your customers use your visualiser, we process their photos and usage records on your behalf, to provide the service. We will:
- process that data only to provide, secure and support the service, and on your documented instructions (these terms are those instructions);
- make sure the people who handle it are bound by confidentiality;
- keep it secure, and tell you without undue delay if we become aware of a personal data breach affecting it;
- use only the sub-processors listed in our Privacy policy, and tell you before we add or replace one;
- help you respond to requests from people exercising their data protection rights;
- delete it at the end of the service, unless the law requires us to keep it, and give you the information you need to show compliance.
Your content and ours
- You keep ownership of your logo and business details. You give us permission to show them in your visualiser and hosted page while you subscribe.
- Your customers keep ownership of their photos. They can download their before-and-after images and use them freely.
- All rights in the Resurface service, software, design, catalogue and brand belong to us or our licensors. We give you a non-transferable, non-exclusive right to use the service in line with these terms while you subscribe.
Availability
We aim to keep Resurface available, but we do not promise that it will always be available or free of errors. Previews are rendered on third-party GPU servers and can be delayed by demand or while servers start up. We may suspend the service for maintenance or for security reasons. If your visualiser is unavailable for a long time through our fault, contact us and we will put it right, for example with a partial refund.
Our liability
- We exclude all implied terms, conditions and warranties as far as the law allows.
- We are not liable for loss of profit, revenue, business, contracts, goodwill or data, or for any indirect or consequential loss, including any loss arising from a customer relying on a preview.
- Our total liability to you in any 12-month period is limited to the amount you paid us in that period.
- You will compensate us for claims by third parties that arise from your website, your quote button link, or your breach of these terms.
- Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to limit or exclude.
Ending the service
- If we stop providing Resurface altogether, we will give you at least 30 days' notice and refund any amount you have paid for the period after the service ends.
- We may close your account if you seriously or repeatedly break these terms, or if the law requires us to.
Changes to these terms
We may update these terms, for example to reflect changes to the service or the law. We will email you at least 30 days before significant changes take effect. If you do not agree to them, you can cancel before then.
General
- We may transfer this agreement to another person or business. We will tell you if we do, and your rights will not be reduced. You may not transfer your rights without our written agreement.
- No one other than you and us has any rights under these terms.
- If a court decides that part of these terms is invalid, the rest still applies.
- If we do not enforce a right straight away, we can still enforce it later.
- These terms, together with the policies linked above, are the whole agreement between you and us about Resurface.
Governing law and disputes
These terms are governed by the law of England and Wales, and disputes will be decided by the courts of England and Wales.
